Sapphire Elite Staff is a commercial brand operated through ONNIS FOOD EXPERIENCE, a French single-member SARL with share capital of €10,000, registered with the Nice Trade and Companies Register under number 992 055 772, with its registered office at 62 Avenue Jean Médecin, 06000 Nice, France.

2. Scope of this Policy
This Policy explains how we collect, use, retain and protect personal data when you visit the site, submit a staffing request, apply, join our network, create or use an account, contact us, or interact with our services and recruitment process. It applies to visitors, candidates, clients and other persons who interact with us.

A. Identification and contact data: first name, last name, title, email address, telephone number, city, region, country, residence and communication preferences.
B. Candidate and professional data: target roles, experience, qualifications, certifications, training, languages, availability, mobility, references, portfolio, menus, images, videos, CVs and uploaded documents.
C. Client request data: service, needs, dates, budget, preferences and information relating to a residence, yacht, property or event.
D. Account and access data: authentication, profile, dashboard activity and access logs.
E. Technical data: IP address, browser, device, operating system, usage, sessions, performance and analytics.
F. Consent and preference data: cookie choices, browsing preferences, consent dates and times, and communication preferences. We ask that you do not upload unnecessary or excessive sensitive data.

5. Purposes of Processing and Legal Bases
We process personal data only where there is a valid legal basis. Authorised internal teams of Sapphire Elite Staff (${company}) may process such data. The purposes include reviewing and assessing applications, matching and staffing requests (contract or pre-contractual measures, legitimate interests); account management and website operation (contract, legitimate interests); communications and support (pre-contractual measures, legitimate interests); legal obligations, security, fraud prevention and record retention (legal obligation, legitimate interests); analysis and improvement of the site (legitimate interests or consent where required).
6. Candidate Documents and Uploaded Content
Candidates may upload their CVs, certifications, references, portfolios, menus, photographs, examples of work and professional documents. Additional documents may be requested for verification, compliance or operational assessment. Uploaded content is processed only to the extent reasonably necessary for legitimate recruitment, evaluation, verification, matching and placement purposes.
7. Sharing of Personal Data
We may share personal data when necessary and proportionate with technology providers, hosting providers, database providers, authentication providers, storage providers, analytics providers, email providers, professional advisers, clients or prospective clients where relevant, and authorities where required by law. Service providers may act as processors or independent controllers depending on their role. We do not sell personal data.
Audience analytics: with your consent, the site uses Google Analytics 4 (Google Ireland Limited / Google LLC) and Vercel Analytics (Vercel Inc.). These third parties process the browsing data collected by these tools and are solely responsible, as service providers or independent controllers, for the processing they carry out for their own purposes, under their own privacy policies. Transfers outside the EEA may occur, covered by the safeguards offered by these providers (including standard contractual clauses or the EU-US Data Privacy Framework).
8. International Data Transfers
Some providers may process data outside the EEA. Where necessary, we implement appropriate safeguards, including EU Standard Contractual Clauses, equivalent mechanisms and provider security and compliance measures.
9. Data Retention Periods
Client accounts and contracts are retained for the duration of the relationship and then for up to 5 years in intermediary archive for evidentiary purposes. Client requests are retained for up to 24 months after the last meaningful interaction. Candidate profiles and documents are retained for up to 24 months after the last update or interaction. Administrative data follows the applicable legal deadlines; accounting records are kept for 10 years. Technical logs are retained for as long as reasonably necessary. Local cookie preferences expire after 6 months; the server consent evidence register is retained for 3 years in accordance with the applicable retention policy. When an account remains inactive for 12 months, we may prompt the user to refresh or update their profile information, to maintain accurate records and legal compliance. Some data may be kept longer to exercise or defend rights, comply with law, resolve disputes or prevent abuse.
10. Data Subject Rights
In accordance with the GDPR, you have the right to access, rectify, erase, restrict, object, data portability where applicable, and withdraw consent without retroactive effect. You may also set post-mortem directives and submit a complaint to the CNIL. We may request proof of identity and will normally respond within one month, which may be extended by two months where necessary.
11. Security Measures
We implement appropriate technical and organisational measures, including access controls, authentication, controlled internal access, secure infrastructure, monitoring, incident response, minimisation and confidentiality. No online system can be guaranteed to be 100% secure. In the event of a breach likely to create a risk, we will notify the CNIL within the legal deadlines and inform affected individuals where the risk is high.

We also use an internal, cookie-free page view counter: it records only the page viewed, the language, the date and time and the referring site, with no IP address or identifier, for aggregate statistics only.
