These Terms and Conditions (“Terms”) govern access to the website, forms, restricted areas and recruitment services provided by Sapphire Elite Staff (“Company”, “we”, “our”). Sapphire Elite Staff is a commercial brand operated through ONNIS FOOD EXPERIENCE, a French single-member SARL with share capital of €10,000, registered with the Nice Trade and Companies Register under number 992 055 772, whose registered office is located at 62 Avenue Jean Médecin, 06000 Nice, France. By accessing or using the site, submitting an application or staffing request, uploading materials or creating an account, you confirm that you have read, understood and accepted these Terms.

We may modify these Terms at any time. The changes take effect from their publication on this page. We may also update, suspend, restrict or interrupt all or part of the site, services or features for technical, operational, legal or commercial reasons.

The platform mainly allows the submission of staffing requests, receipt and management of applications, pre-selection, matchmaking, profile presentation, administrative processes and, where applicable, the display of offers. The site operates as a platform for intermediation, recruitment assistance and professional matching. The service does not guarantee placement, hiring, assignment, suitability or availability of a candidate, client acceptance, interview, commercial result or specific recruitment outcome. Offers are indicative and do not constitute a binding offer.

To access certain services, users may need to register or provide information. You confirm that you have the necessary legal capacity, provide accurate, complete, lawful and up-to-date information, are authorised to upload the submitted items, protect your credentials and inform us of any unauthorised access. We may restrict, suspend or refuse access where the information is inaccurate, incomplete, unauthorised or inappropriate.

Use of the site is only authorised for lawful purposes. You must not submit false or unauthorised information, upload third-party data without authorisation, upload unlawful content or content that infringes rights, introduce malware, obtain unauthorised access, impair security or performance, copy or exploit the content without authorisation, or circumvent the Company’s role in recruitment.

Candidates may submit CVs, certifications, references, portfolios, images and supporting documents. Clients may submit staffing requests and operational requirements. No submission guarantees review, response, interview, representation, placement or future engagement. Users are solely responsible for the accuracy, lawfulness and relevance of the information and items submitted.

We apply high standards of discretion. Information relating to clients, candidates and recruitment processes must be treated confidentially and must not be disclosed, shared or used improperly.

The brand, texts, layout, design, code and content of the site are protected by intellectual property laws. Uploaded items remain the property of the user, who grants the Company a limited, non-exclusive right to use them for recruitment, evaluation, matching and presentation purposes.

The site may include third-party tools or links. We do not control their content, availability or policies and are not responsible for them.

No fees are charged to candidates for the submission of applications. The commercial terms applicable to clients are governed by separate agreements.

We may suspend or terminate access or accounts in the event of breach of these Terms, abusive use, false or misleading information, or security or compliance concerns.

The site and services are provided “as is” and “as available”. We do not guarantee uninterrupted operation, review of every submission, suitability or availability of candidates, client decisions or any recruitment or commercial result. Any marketing wording is indicative only.

To the maximum extent permitted by law, the Company is not liable for indirect or consequential losses, loss of opportunity, profits or data, decisions of candidates or clients, failed placements or recruitment outcomes.

You agree to indemnify the Company against any claim, damage or cost arising from abusive use of the site, breach of these Terms, uploaded content or infringement of third-party rights.

Strictly necessary technologies may be used for operation, authentication, security, sessions and requested services. Optional analytics technologies are used only in accordance with your preferences and the law. You may accept, refuse or personalise optional technologies via the banner and change your choice through “Manage cookies”. Please see the Cookie Policy.

Personal data is processed in accordance with the GDPR and applicable French law. The purposes, legal bases, recipients, retention periods and rights are described in the Privacy Policy. These Terms are governed by French law. Any dispute falls within the exclusive jurisdiction of the Tribunal Judiciaire de NICE, subject to mandatory rules of applicable law.

If any provision is invalid, the remaining provisions remain effective. Failure to enforce a provision does not constitute a waiver. Specific agreements concluded with clients or candidates prevail, where applicable.
